Terms & Conditions

Last updated: June 30, 2026

These Terms & Conditions (“Terms”) govern your access to and use of digitalstorming.com and services offered by Digital Storming LLC, a Delaware limited liability company. By using the website, submitting a form, requesting a quote, making a payment, or engaging our services, you agree to these Terms.

Services

Digital Storming LLC may provide business, digital, trucking support, dispatch support, CDL support, compliance support, factoring assistance, website, hosting, marketing, SEO, AI voice agent, automation, call handling, and related services. The exact scope, pricing, timeline, deliverables, and responsibilities are controlled by the applicable proposal, invoice, order form, written agreement, or service-specific terms.

We may accept, decline, suspend, or discontinue services where legally required, where information is incomplete, where required access is not provided, where payment is overdue, or where a request violates law, platform rules, carrier rules, acceptable-use requirements, or these Terms.

No Guaranteed Results

Unless a written agreement signed by Digital Storming LLC expressly says otherwise, we do not guarantee specific revenue, loads, rates, rankings, leads, sales, traffic, approvals, uptime, funding, insurance savings, compliance outcomes, legal outcomes, platform approvals, or business results.

Customer results depend on many factors outside our control, including market conditions, customer approvals, budgets, third-party providers, carrier/broker/shipper behavior, search and ad platforms, laws, account standing, customer content, and operational decisions.

Trucking, Dispatch, CDL, Insurance, Compliance, and Factoring Disclaimers

Digital Storming LLC is not a motor carrier, freight broker, insurer, factoring company, lender, law firm, tax advisor, or legal advisor unless a separate written agreement specifically states otherwise.

Dispatch and trucking support is administrative and operational support. Carriers make the final decision on every load, route, broker, shipper, rate, equipment, insurance provider, safety matter, compliance action, and operating decision.

Rates, load availability, revenue, coverage, profit, savings, delivery timelines, insurance approval, factoring approval, CDL outcomes, compliance outcomes, and legal outcomes are not guaranteed.

Insurance, factoring, lease-on, CDL, and compliance referrals or guidance are third-party recommendations or general support only. You should review all terms and consult qualified professionals before making decisions.

Website, Marketing, AI, and Automation Disclaimers

Websites, hosting, SEO, paid ads, social media, YouTube, AI voice agents, automation, and call-handling services may depend on third-party platforms and integrations. We are not responsible for third-party outages, policy changes, account restrictions, algorithm changes, API changes, customer-supplied content, or customer delay.

AI voice agents and automation can produce errors and require monitoring, scripts, training data, and fallback processes. You are responsible for reviewing scripts, legal consent requirements, business rules, and the accuracy of information supplied to AI or automation tools.

Customer Responsibilities

  • Provide accurate information, required access, approvals, documents, and timely feedback.
  • Maintain required licenses, insurance, permits, authority, compliance records, and account credentials.
  • Review deliverables, forms, scripts, websites, ads, campaigns, dispatch options, and third-party terms before use.
  • Use services lawfully and in compliance with applicable platform, carrier, broker, shipper, DOT/FMCSA, privacy, SMS, marketing, advertising, and industry requirements.
  • Pay invoices, fees, subscriptions, retainers, or usage charges when due.

Payments and Refunds

Fees, billing frequency, refund eligibility, cancellation rights, and payment terms are stated on the applicable checkout page, invoice, proposal, or written agreement. Unless stated otherwise, fees for completed work, setup work, third-party costs, custom work, and already-started service periods are non-refundable.

Limitation of Liability

To the maximum extent permitted by law, Digital Storming LLC will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-revenue, lost-data, lost-load, lost-business, or third-party damages. Our total liability for any claim is limited to the amount you paid us for the specific service giving rise to the claim during the three months before the event.

Indemnification

You agree to defend, indemnify, and hold harmless Digital Storming LLC and its owners, employees, contractors, and vendors from claims arising from your content, instructions, accounts, operations, use of services, violation of law, violation of third-party rights, or breach of these Terms.
